Mitigating Data Center Environmental Risk

Rapidly expanding facilities face unexpected liabilities like noise pollution, stormwater runoff, and electronic waste, turning discretionary coverage into a business necessity.

The growing demand for artificial intelligence and cloud computing infrastructure has led to the development of data centers of unprecedented size and scale. Yet, many of the owners, developers, and operators still view environmental liability insurance as an optional purchase.

While data center owners manage a $2 trillion global asset base, according to S&P Global Ratings, a significant portion of these assets remain under-insured against environmental liability risks. Data from Swiss Re Institute indicates that 75% of insurance premiums are concentrated in property, construction, builders’ risk, and excess casualty policies that protect the physical facility and guarantee uptime, leaving environmental risks largely unfunded. Other high-profile lines of insurance such as cyber liability and errors and omissions consume the remaining 25% of insurance budgets. Consequently, fixed-site environmental coverage may be considered a discretionary expense, which is a critical misunderstanding of the actual exposure.

This misperception is reinforced by the false assumption that technology infrastructure is inherently safe, unlike heavy industrial operations like chemical plants or refineries. Since data centers do not produce streams of toxic waste as a primary output, the sector is often viewed as a clean occupancy. Yet, data centers, much like heavy industrial facilities, present diverse and potentially severe environmental exposures during construction, daily operations, and equipment disposal. These risks can emerge long before the first server is plugged in.

Relying solely on standard commercial insurance programs can leave an organization exposed to potentially severe financial losses, as traditional corporate policies contain absolute pollution exclusions. Such standard clauses functionally eliminate coverage for liabilities stemming from construction runoff, underground tank leaks, water discharges, neighbor noise disputes, and electronic waste.

Construction Risks

These exposures begin the moment ground is broken on a new site. Modern data centers are enormous, hyperscale projects spanning as much as 50 to over 1,000 acres. Developers frequently purchase land in urban or industrial corridors to remain close to power grids and major fiber-optic lines. As a result, these sites are often categorized as Brownfield properties that carry legacy contamination from historical operations, such as heavy metals, pesticides, or volatile organic compounds in the soil and groundwater.

When grading begins on a Brownfield site, developers risk discovering previously unknown contamination or disrupting hidden hazards like abandoned underground storage tanks or hot-spots of industrial solvents, which could trigger immediate regulatory action, halt construction schedules, and force expensive cleanup obligations.

Regardless of the site’s history, the initial excavation stage carries elevated risk. Even on pristine greenfield sites, building the hubs requires immense infrastructure, involving substantial earth moving, trenching, and underground utility installation that can generate severe exposures. Silt and sediment runoff from grading projects can pollute local waterways, potentially leading to fines and penalties from environmental regulators. Additionally, the heavy machinery required for this earth-moving work relies on thousands of gallons of hydraulic fluid and fuel. A single spill from a refueling tank can incur expensive and unanticipated remediation costs.

Once digging stops, building the actual facility permanently changes how the land handles water. To support heavy server racks and prevent floors from settling, developers must pour concrete foundations that are typically up to three times thicker than standard foundations and can weigh hundreds of thousands of tons. This installation alters the property’s natural drainage patterns and potentially impacts groundwater behavior. Since the concrete is impermeable, millions of gallons of water can no longer soak into the ground, easily flooding neighboring properties. The resulting runoff can carry silt and sediment, which is classified as a pollutant under environmental law, forming the basis for a potentially covered environmental claim.

If a data center site floods a neighbor’s property, erodes land, or leaves heavy sediment deposition, the owner is exposed to property damage claims that are costly and time-consuming. The financial reality of this exposure is already evident in analogous mega-scale industries: In Georgia, a federal jury awarded a neighboring couple $135.5 million in a lawsuit against a solar farm developer after a failure to install adequate erosion control measures allowed mud and sediment to ruin the neighboring property. Even in the absence of a nuclear verdict like this one, the duty to defend in an environmental insurance policy can be invaluable to data center operators.

Operational and Disposal Hazards

While construction hazards pose an immediate threat, a facility’s long-term environmental exposures evolve once the data center becomes operational. At this stage, primary environmental threats stem directly from critical backup power infrastructure, high-volume cooling operations, and continuous broadband and tonal noise.

To guarantee uninterrupted uptime, facilities house heavy equipment like diesel-fired backup generators, supported by thousands of gallons of fuel stored in underground or aboveground tanks. Leaking storage tanks and ruptured fuel lines are among the most frequent sources of environmental claims. A slow, undetected leak from an underground line can migrate over months or years, contaminating onsite or adjacent groundwater, or even municipal water supplies, and triggering multi-million-dollar remediation projects.

Cooling systems present a parallel, high-volume vulnerability. Data centers consume, treat, and discharge immense volumes of water or chemical refrigerants to prevent servers from overheating. Closed-loop cooling systems often rely on water treated with biocides, glycols, anti-scaling agents, and rust inhibitors, alongside heavy metals like copper and zinc from plumbing components. If a pipe fails or wastewater is improperly flushed into municipal drains, the chemically treated waters can escape into local stormwater systems, potentially causing natural resource damage and widespread fish kills, leading to costly lawsuits and heavy regulatory cleanup mandates.

Beyond chemical and water threats, noise is a continuous, often-overlooked operational risk. The non-stop running of massive fans, liquid cooling chillers, transformers, generators, and HVAC equipment needed to stabilize server temperatures generates constant, low-frequency sound. Neighbors frequently object to this ambient drone and may pursue legal action through nuisance claims. Because state case law is highly inconsistent regarding whether noise constitutes a pollutant, environmental insurers handle this exposure differently. Insurers like Ascot may provide this coverage via an optional endorsement to the policy. Consequently, if a neighbor alleges excessive noise or vibration emanating from a site, policyholders may have contract certainty that the Insurer covers the risk, including legal defense and settlement costs (subject to terms and conditions of the policy).

Environmental Risk Transfer

Relying solely on traditional insurance policies or a large balance sheet to handle these risks can leave a business exposed to potentially severe litigation and regulatory actions. Bespoke environmental liability policies can fill the liability gaps left by traditional coverage, insuring explicit exposures like on-site fuel spills, wastewater accidents, climate-driven physical damage, and third-party noise claims.

Without environmental insurance, data center owners and operators must be prepared to absorb exorbitant, out-of-pocket legal fees, even in the absence of negligence or liability. Because an insurance policy’s duty to defend is broader than its duty to indemnify, securing an environmental program protects against these uninsured costs. With the proper coverage in place, the insurer assumes the legal defense, covers legal costs from day one, and provides immediate access to highly qualified attorneys and environmental experts to manage the case.

Data center owners and operators can optimize their risk management processes by partnering with a specialty environmental insurer to secure tailored coverages for their specific risk profile. For example, dedicated Non-Owned Disposal Site (NODS) liability insurance shields against future cleanup liabilities at third-party waste repositories. Special permit compliance coverage provides crucial access to funding to retain environmental consultants and defense counsel, ensuring rapid regulatory realignment if a regulator alleges a Clean Water Act stormwater or water discharge permit violation.

Ultimately, environmental insurance should be evaluated as a core risk-transfer tool rather than an optional purchase to secure long-term operational resilience. As the data center industry matures and faces stricter regulatory scrutiny, treating environmental insurance as a discretionary purchase may no longer be a viable strategy.
